An order or a judgment pertaining to the rights in a real property, trust litigation, or will litigation may be appealed if the judge of probate court, or the judge of civil court handling the real property matter, makes a mistake. The mistake may be regarding the facts of a case, laws of California, Federal laws, laws of other jurisdictions applicable to the case, or application of laws to facts of the case.
A three-panel judge of the California Court of Appeal will decide if the judge has made a mistake in his or her ruling. California Court of Appeal may confirm the judgment, may reverse the judgment, or may reverse the judgment with a direction to the judge to do something with the judgment.
The time to appeal an order or judgment is jurisdictional. A party that intends to appeal an order or a judgment must act before the expiration of limitation period for appealing the order or judgment. Depending on the type of order or judgment, different statute of limitations applies for filing a notice of appeal.
In rare cases, the decision of California Court of Appeal may be reviewed by the California Supreme Court. California Supreme Court may hear a case if substantial rights of others would be affected by the decision.
